Why do we need your information?

BOOST will process your personal data for the following purposes:

Customer Management

BOOST is dedicated to selling tourism entertainment products, through physical stores, its own website, and online sales platforms. The processing of your data is necessary for fulfilling the sales or service contract to be signed between you and BOOST.

We process and store your personal data to the extent necessary to fulfill applicable contractual and legal provisions. Thus, the personal data processed will be retained for the duration necessary to provide the contracted services and to meet tax and legal obligations.

Marketing

BOOST may process your data to send you information about its products and services.

This data processing will only be carried out with your consent, given when you purchase a BOOST product. If you consent, it means you agree to receive marketing communications via email and SMS. BOOST may also share your data with third parties who manage social networks, such as Facebook, for the purpose of conducting marketing campaigns on social networks.

Consent for the processing of personal data for direct marketing purposes can be revoked at any time.

Your data will be retained for this purpose for an indefinite period.

Profiling

BOOST may perform customer profiling based on information related to your purchases. Whenever you buy a BOOST product or service, in addition to your personal data, we record the products purchased, amounts paid, date and time, as well as the place of purchase or delivery.

This way, we can actively inform and advise you about our products and services using appropriate records for this purpose, thus enabling targeted communication and advertising. BOOST applies all appropriate measures to safeguard your rights and freedoms in this context.

Therefore, you may exercise your rights at any time and:
(i) request clarification regarding the terms and criteria under which the profile is created;
(ii) contest decisions made based on automated decisions;
(iii) request human (non-automated) intervention.

In the case of customer profiling solely for commercial purposes, you may object to this profiling using the contacts provided above.

Store Surveillance

BOOST's store is equipped with a video surveillance system, duly signposted. The CNPD declared that the processing of personal data resulting from video surveillance, with the mentioned limitations, is appropriate, relevant, and not excessive in relation to the declared purpose (cf. item b) of paragraph 1 of article 5 of Law no. 67/98, of October 26, amended by Law no. 103/2015, of August 24 - LPD) and the activity developed by MVMS, SA.

Image recordings obtained by video surveillance systems are kept, in an encrypted record, for 30 days from the date of capture, after which they are destroyed (without prejudice to longer retention in case of judicial proceedings).

Other Questions

Will my information be shared with others?

Your personal information is not disclosed to third parties, being only processed within BOOST.

Exceptionally, your personal data may be processed by companies subcontracted by BOOST, namely for website hosting, email, user inquiries about services, sending information about new services and products, and special offers. Only the personal data necessary for providing the service in question is provided to these companies.

Your data will be processed within the European Union.

What are my rights?

BOOST guarantees all your rights regarding the processing of your data, in accordance with the GDPR, namely: the right to information, the right to rectification of your data, the right to erasure, the right to restriction of processing, the right to object, and the right to data portability. In addition, there is the right to lodge a complaint with a supervisory authority in accordance with the GDPR.

You can request a copy of the consents you have given us at any time.

You may revoke the consent given for the processing of your personal data at any time, whenever such processing is based solely on that consent (for example, for direct marketing purposes). The same applies to consents given before the entry into force of the General Data Protection Regulation, i.e., before May 25, 2018. Note that revocation and opposition do not have retroactive effect, so processing carried out before revocation or opposition will not be affected.

Right of Access

The data subject has the right to obtain from BOOST confirmation as to whether or not personal data concerning them is being processed, and, where that is the case, access to their personal data and access to the information provided by law.

If you request more than one copy of your personal data being processed, BOOST may charge a fee for administrative costs.

Right to rectification

The data subject has the right to obtain from BOOST, without undue delay, the rectification of inaccurate or incomplete data concerning them.

Right to erasure of data

The data subject has the right to request BOOST to erase their data, without undue delay, and BOOST has the obligation to erase personal data when, namely, one of the following reasons applies:

  1. Personal data is no longer necessary for the purpose for which it was collected or processed;
  2. The data subject has withdrawn their consent to the processing of data (in cases where the processing is based on consent) and there is no other legal basis for such processing;
  3. The data subject objects to the processing and there are no overriding legitimate grounds for the processing.

Right to restriction of processing

The data subject has the right to obtain from BOOST the restriction of processing if one of the following situations applies:

  1. Contesting the accuracy of personal data, for a period that allows BOOST to verify its accuracy;
  2. Data processing is lawful and the data subject opposes the erasure of their personal data and requests instead the restriction of its use;
  3. BOOST no longer needs the personal data for processing purposes, but the data is required by the data subject for the establishment, exercise, or defense of legal claims;
  4. If the data subject has objected to processing, pending verification of whether the legitimate grounds of the controller override those of the data subject.

Right to data portability

If the processing depends on the data subject's consent and this consent has been given by automated means, the data subject has the right to receive the personal data concerning them and which they have provided to BOOST in a structured, commonly used, and machine-readable format.

Right to object

In cases where the processing of data is carried out for the purposes of legitimate interests pursued by BOOST; or the processing is carried out for direct marketing purposes; or profiling is made, the data subject can, at any time, object to the processing of their personal data.

CAN I REVOKE MY CONSENT LATER?

If consent is legally necessary for the processing of personal data, the data subject has the right to withdraw consent at any time, although this right does not compromise the lawfulness of the processing carried out based on the consent previously given, nor the subsequent processing of the same data based on another legal basis, such as the fulfillment of a contract or a legal obligation to which BOOST is subject.

If you wish to withdraw your consent, you can contact us by letter, phone, or email at clientes@boostportugal.com.
